Our office at Ash House is now open for face to face client meetings as an alternative to virtual meetings if this is preferable. We continue to offer Zoom/telephone meetings, however we find that, in particular, a face to face first discussion is something welcomed by new clients.
Jam today?
We have numerous cases where the current settlement proposals are fine for our client’s current needs, but what about the future? We look ahead and try to ensure there is sufficient “jam” going forward to retirement and, where appropriate, future care needs.
Maintenance Orders
We have recently had a series of successes in terminating a joint lives maintenance Order continuing the trend which first started in 2011 with one of Mercy’s reported cases of L v L 2011 EWHC 2207.
Our latest success caused our client to say:

However, before embarking on the exercise of attempting to vary a maintenance Order, clients need the help of experienced advisers as to the return on the costs investments to make it worthwhile.
Bank of Mum and Dad
Increasingly we are advising the family members who have advanced funds to, for example, their children and are concerned as to how their funds should be protected in the event of a marital breakdown.
Sadly, such contributions, many being extremely generous, are treated only as “contributions” of the party whose family has transferred the funds. This means that it is rare for the recipient to receive the full benefit of the family generosity on divorce.
So, the moral is, get advice in advance before the funds are released.
Certainty or risk
In today’s tumultuous times we find that clients are increasingly wishing to exert control over their futures by way of resolving issues with their former partners and reaching a consensus as opposed to the uncertainty and expense of litigation.
We are fully supportive of this approach and keen to advise on ADR with particular reference to private financial dispute resolution meetings as opposed to hearings.
